The State of Arizona only accepts one date as your date of separation: the date your spouse is served with divorce papers. If you have community assets or debts that will need to be divided in the course of divorce, the sooner you file the sooner the clock stops on what is considered community responsibility.
Legal separation is the process by which parties divide assets and liabilities and terminate the "community" just as they would in a divorce but at the end of the process the parties remain legally married. Legal separations must be processed through the Courts just like a divorce.
Contact an attorney immediately. In the State of Arizona you have 20 days to file a response with the Court upon being served, if you were served outside of the state of Arizona you have 30 days to file a response. If no response is received by a Court within those timeframes you risk that your spouse will proceed on the divorce by way of a Default Judgment. In a default divorce you waive your right to having a say in the division of marital assets and liabilities and may end up with an unfavorable settlement.
